Email To Attorney General Shurtleff Re. Status of U CCW Ban
21 April 2003

Mark,

What is the status of the U of U gun suit? I understand the federal judge bounced it back to State court, but I haven't heard anything since then. And it looks like the U's illegal and dangerous gun policy remains in effect, though admittedly only against employees (including faculty, staff, etc) and students of the U while visitors to campus are now free to CCW. This strikes me as both illegal, dangerous, foolish, as well as discriminatory against U students and employees.

Is there some way your office can and will get this ban ended, or at least suspended until the suit is over? As it is, Bernie has little or no reason to press the issue. The ban remains in effect, and there is always the chance that an AG, less inclined to put the letter of the law over politics or emotion, will win the next election. The ban needs to be ended, NOW. And those perpetuating this ban need to be treated with the same severity and expediency as were those airline officials who denied boarding to Utah residents based on skin color.

Please let me know where things stand, when we can expect some motions, suits, or other efforts from office to have this ban suspended until it is finally struck down once and for all, and what GOUtah! can do to help.

If any person finds the new law objectionable and really believes it violates our Constitution, he should file suit and let the question be decided after full and proper arguments have been made. It is completely unacceptable for anyone or any group to unilaterally decide to ignore the law. Please enforce our laws that our system of government may be preserved and respected.

Thank you.
