Model Language for Employers and Others Regarding Firearm Possession

Many Utah gun owners have asked for information on model language for employers and others regarding firearm possession. Gun Owners of Utah (GOUtah!) has developed this language which we believe squares with existing state law and helps to protect the rights and interests of both the Utah gun owner and the employer or business owner. Any such policy is a guideline only, and has no force of law or regulation, per Utah’s state preemption statutes. We welcome your suggestions and hope it will be of assistance for those seeking guidance on this issue.

Model Language - Policy Regarding Firearms Possession by Employees, Vendors or Customers

The (Department/Company/Organization) recognizes that the lawful possession of firearms is a constitutionally-protected individual right which is widely practiced by our employees, vendors and customers. As such, we wish to make reasonable accommodation for our employees, vendors or customers to lawfully exercise this right if they so choose, under the following policy guidelines:

  1. The (Department/Company/Organization) neither encourages nor discourages the lawful possession of firearms in or about the workplace by our employees, vendors or customers.

  2. The (Department/Company/Organization) accepts no liability or responsibility, civil or criminal, for any possession, use or misuse of a firearm in or about the workplace by our employees, vendors or customers.

  3. Any employee, vendor or customer of (Department/Company/Organization) who wishes to possess a firearm in or about the workplace should do so in compliance with all applicable federal, state and local laws.

  4. Any employee, vendor or customer of (Department/Company/Organization) who wishes to lawfully possess a firearm in or about the workplace should, based on the employee’s, vendor’s or customer’s individual circumstances and situation, maintain a reasonable and prudent level of security over the firearm to ensure the firearm is inaccessible to unauthorized use.

  5. Those employees, vendors or customers of (Department/Company/Organization) who wish to carry a firearm under authority of a valid Concealed Firearms Permit may do so, with the clear understanding that except for duly-sworn law enforcement officers or armed security personnel in the performance of their official duties, the possession and/or use of a firearm has no connection whatsoever with the official duties or responsibilities of their job, and that a Concealed Firearms Permit does not convey any authority to the permit holder for any use of force beyond that normally held by any other private citizen.


Remember that getting this information is meaningless unless YOU ACT ON IT TODAY. If you just read it and dump it in the trash, your gun rights, and the gun rights of future generations go in the trash with it. Get involved, get active and get vocal!
